MÖTLEY CRÜE’s Motion To “Dismiss” Mick Mars Lawsuit Is “Denied”, Court To Review Fraudulent Use Of “Backing Tracks”

More dirt has leaked out about the Mick Mars legal battle versus his old bandmates. Word is that Nikki Sixx and his legal team faced their first loss in the court against their old guitar player.

MÖTLEY CRÜE‘s legal counsel filed a ‘pretrial motion’ last week to ask the Mars lawsuit be thrown out on the grounds of “a bogus complaint” with no merit.

A motion to dismiss is where one side of the lawsuit asks the judge to throw out or dismiss the case without reviewing all the legal arguments and case facts. You can make a motion to dismiss at any time during the case. However, it’s usually a pretrial motion that the defendant uses at the start of the case proceedings.

When you make a motion to dismiss, you’re alleging that based on the allegations and facts that are in the Complaint, the claim does not have any validity. So, you are saying that the case shouldn’t proceed. There can be many reasons that you would file a motion to dismiss.

As the story goes, the court has now officially today denied the defense request for a dismissal and will prepare to begin hearing testimony and reviewing evidence next related to the fraudulent use of “backing tracks” by MÖTLEY CRÜE for main instrumentation during The Stadium Tour last year, wherein Mick Mars contends he was the only member of the band performing for real without prerecorded tape.

So, anyone who might think that this lawsuit was one big “publicity stunt” is wrong, according to the industry source, who tipped TMD off, and has been given access to court documents related to the Mars lawsuit. These legal papers can’t be shared online, for it would be against the law.

Mars is suing to win back the “shares” being taken from him by his old band, and also seek to gain “majority shareholder” status since he helped create the band and named it himself, and besides Nikki Sixx, he is the only constant member of the band over 41 years.

If Mars scores a legal upset, and is found to have been treated unjustly, and was “gaslighted” as he contends, using sabotage on the tour to ruin his reputation and the stability of the band, then Mars can essentially fire everyone in the band and reboot a brand new version of the Crue.
