Lawyers representing Ozzy Osbourne have filed a lawsuit with the U.S. Patent and Trademark Office against Black Sabbath bandmate Tony Iommi, claiming that the guitarist illegally claimed sole ownership of the band’s name. Osbourne is suing Iommi for a 50 percent interest in the Black Sabbath trademark, along with a portion of Iommi’s profits from use of the name, according to the New York Post.


The suit follows one filed by Iommi in December 2008 against Live Nation, in which Iommi claimed the concert giant sold merchandise bearing the band’s logo and likeness despite the fact the their merchandising deal ended in 2006. Soon after that agreement concluded, Iommi reclaimed the band’s trademark. His suit seeks damages and a halt to Black Sabbath product sales by Live Nation.

“There’s been a little chatter here and there about us filming a few shows this summer for potential release on DVD and among the countless internet rumors, these ones are actually true! We thought it would be cool to document a few shows that are unique and sure to be extra memorable for us, and hopefully for you too . . . first up are the three sold out shows in Mexico City, Mexico at Foro Sol on June 4, 6, 7 and later this summer, we also plan to have the cameras rolling at the sold out show in Nimes, France at Arenes de Nimes, the historic Roman amphitheatre where we’ll be on July 7.

For any Metallica friends going to these shows, bring your war faces and don’t be scared of the cameras!!

Apple’s recent rejection of a Nine Inch Nails iPhone app update has caused quite the mini-firestorm across the Internet. Apple-bashing may be the important part of the story to some, but there is a business lesson amidst the noise.

The main part of the story, missed by many reports, is that Apple has different standards for iPhone app content than it has for iTunes music store content. According to a post at the Nine Inch Nails forum, Apple’s email specified that the app was rejected for violating Apple’s Section 3.3.12 from the iPhone SDK Agreement. The specific content in question is the video for “The Downward Spiral.” The iPhone SDK Agreement, according to the email from Apple, states:

DROWNING POOL – To Join Crüe Fest 2 Tour Starting July 19th in Camden, NJ


The band that will never say die from Dallas, Texas is Drowning Pool… and the act has recently returned after playing a private show for the troops at Guantanamo Bay on Memorial Day, May 25.

Vocalist Ryan McCombs adds:

“Anytime we get the chance to play in front of the troops, it is a great honor and they’re always the best crowds. When we got the call we were like, ‘Hell yeah’, let’s go rock Guantanamo Bay. It’s a once in a lifetime chance and I don’t know of many artists that get an invitation like this.”
